These Terms of Service (“Terms”) govern your use of Cast Browser (the “App”), provided by Cast Browser (“we,” “us,” “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App and what it does

The App is a general-purpose web browsing tool that may help identify playable media resources on websites and, where supported, facilitate playback on compatible devices using Apple AirPlay and/or Google Cast/Chromecast (collectively, “Casting”). The App does not own, host, or control third-party websites or their content.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you use the App on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. License and restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use.

You may not (and may not attempt to):

  • Reverse engineer, decompile, or disassemble the App, except to the extent permitted by law.
  • Circumvent security, access controls, DRM, paywalls, or other technological protection measures.
  • Use the App in a way that violates any law or infringes the rights of others.
  • Interfere with or disrupt the App or the networks/systems used to provide it.
  • Use automated tools to scrape, crawl, or mass-access websites through the App in a way that violates those sites’ terms or applicable law.

4. Third-party websites, content, and services

A. Third-party content

Websites you visit and content you access through the App are provided by third parties. We do not endorse, sponsor, or guarantee any third-party content, and we are not responsible for its legality, accuracy, availability, or safety.

B. Third-party services and devices

Casting may rely on third-party platforms, SDKs, devices, and services (including but not limited to Apple AirPlay, Google Cast, Chromecast-enabled devices, and device manufacturers). Your use of those services is governed by their terms and policies. We are not responsible for third-party service outages, device behavior, or compatibility changes.

5. Your responsibilities and acceptable use

You are responsible for how you use the App, including ensuring you have the necessary rights, permissions, and authorizations to access, play, and cast any content.

You agree not to use the App to:

  • Infringe copyright, trademark, or other intellectual property rights.
  • Access, stream, copy, distribute, or make available content without authorization from the rights holder.
  • Circumvent DRM or other access controls.
  • Transmit malware, or engage in abusive, harmful, or illegal conduct.
  • Violate the terms of any third-party website or service you access.

6. No storage/hosting promise; compatibility and availability

The App may attempt to detect media resources and facilitate playback, but we do not guarantee that any website, stream, or format will be detectable or playable. Websites may block playback, require authentication, encrypt streams, or change behavior at any time.

If the App offers optional features that involve server-assisted processing (for example, generating a compatible playback URL), such features may be limited, modified, suspended, or removed at any time for technical, legal, or policy reasons.

7. Intellectual property

The App and all related software, designs, and trademarks are owned by us or our licensors and are protected by applicable laws. Except for the license granted in these Terms, you receive no rights in the App.

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without compensation or obligation to you.

8. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the App, you agree to the Privacy Policy: Privacy Policy.

9. Compliance and enforcement; termination

We may suspend or terminate your access to the App at any time if we believe you violated these Terms or if we must do so to comply with law or protect our users, the App, or third parties. We may also remove or restrict features or access to certain sites/content categories as needed.

10. Copyright complaints

If you believe content accessed via the App infringes your copyright, you may submit a notice to our designated agent:

Your notice should include: identification of the copyrighted work, identification of the allegedly infringing material/location, your contact info, a statement of good-faith belief, a statement under penalty of perjury, and your signature (physical or electronic).

We may terminate accounts of repeat infringers where required or appropriate.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CASTING WILL WORK WITH ANY PARTICULAR WEBSITE, STREAM, OR DEVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of the App,
  • Content you access or cast using the App,
  • Your violation of these Terms,
  • Your violation of any third-party rights or applicable law.

14. Governing law; venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. We will update the “Effective date” and may provide notice in the App where required. Continued use of the App after changes means you accept the updated Terms.
